Important Information Regarding Home Buyer Representation - What Buyers Need to Know.

On August 17, 2024, The New Jersey Real Estate Consumer Protection Enhancement Act became law and introduced the Exclusive Buyer Brokerage Agreement (Buyer Agency Agreement).  As a result, in almost every situation, the law requires that the Agreement be executed between a buyer and a licensed real estate agent prior to a buyer or tenant seeing any homes for sale or rent.   In summary, if you are a homebuyer in New Jersey, having an understanding of this agreement is critical in helping you make informed decisions.

Preparing To Buy A Home

Talk with a mortgage broker or lender.

One of the first and most important things a buyer can do is become pre-qualified or pre-approved for a mortgage.  In fact, doing this before you start shopping for a home makes you a better-informed buyer and your offer to purchase will be more attractive to potential sellers.

Develop a wish list.

Know what you have to have and those things you want to have.  Then, write them down and give them to your agent to help us find you the best home for you and your needs.

Think Ahead.

It is so easy to get wrapped up in ones present needs, we all do it.  Therefore, you should also be thinking about your exit strategy when the day comes to move.  Research incicates that buyers expect to stay in a home a median of 15 years, yet typically buyers age 18-44 move in 10 years.

The real estate market has up and downs.  In a seller's market, buyers don't always have their offer accepted.  However, don't get discouraged if you lose out on the first or second home, or if the seller won't meet your offer.

Making An Offer

    • How long the home has been on the market
    • If the price has ever been reduced
    • How much the home is worth.  I will provide you with comparable homes that have recently closed.
    • If there are multiple offers, discuss strategies to make your offer stronger
    • Other items that might be included in the sale (non real property)
    • If the seller is offering buyer concessions and things to consider in asking for one
    • A time line for loan contingencies, home inspections and a closing date
    • If you are using an attorney, we will forward the signed purchase contract to for review which allows for legal advise and appropriate changes.
    • At the time of closing we will join you at the property do accompany you on a final walk-through to make sure it's in the same condition as when you signed the purchase contract.

Additionally, following your instructions, we will prepare a written offer, and present it to the seller's agent.  At that point, the seller can accpt your offer, reject it or present a counter offer to start a negotiation process.  Your Coldwell Banker Riviera Realty agent will work with you to plan a strategy to ensure your most advantageous price and terms.
